Welcome to Arc & Sphere. These Terms of Service ("Terms") govern your access to and use of our website www.arcnsphere.com (the "Site") and the services we offer. By using our Site or working with us, you agree to be bound by these Terms.

1. Our Services

Arc & Sphere specializes in digital visualizations for real estate and architecture, including:

Virtual Staging
Virtual Renovation
Commercial Staging
360 Virtual Staging
2D & 3D Floor Plans
3D Rendering & Animation
VR/AR Experiences
Photo Editing & Day-to-Dusk Enhancements

We reserve the right to modify or discontinue any service at any time.

2. User Responsibilities & Website Use

By visiting our Site or engaging our services, you agree to:

Use the Site lawfully and respectfully
Refrain from copying, modifying, or redistributing any content without written permission
Avoid misuse of our forms, systems, or communication channels
Not submit content or files that infringe on third-party rights or contain malware
Provide clear, complete, and accurate project information when starting a project
Respond to communications (e.g. project confirmations, feedback requests) in a timely manner to avoid delays

You acknowledge that the quality and speed of our service depends heavily on your input and communication.

3. Prohibited Use

You may not use our Site or Services to:

Violate laws or third-party rights
Upload harmful code or disruptive files
Impersonate others or misrepresent your identity
Attempt to reverse engineer or interfere with our systems
Use our visuals in misleading or unlawful contexts

4. Project Process & Revisions

We offer up to three (3) complimentary revisions per image or project stage.
Requests beyond this may incur an additional charge, to be discussed and agreed upon in advance.

We aim for a collaborative and efficient process — detailed briefs and timely feedback ensure the best results.

5. Refund & Cancellation Policy

Our refund and cancellation policy differs based on the type of service:

For Virtual Staging, Digital Renovation, and Photo Editing services:

Cancelled within 12 hours & work not started: Full refund
Cancelled after 12 hours & work not started: No refund, but credit for future use
Cancelled after project starts: Not eligible for refund

For 3D Rendering, Animations, and VR/AR Experiences:

Refund and cancellation terms are handled on a case-by-case basis and are specified in each individual Service Agreement or Project Contract before work begins.

If you’re ever unsure, reach out — we’ll always work with you toward a fair solution.

6. Payments

Projects under €5,000 require 100% upfront payment to begin.
Projects over €5,000 require a 50% deposit to initiate work. The remaining 50% is due upon project completion and before final delivery.

Final deliverables will only be released after full payment is received.

Invoices are sent by email and payable via bank transfer or other agreed methods.

7. Copyright & Licensing

All visual content produced by Arc & Sphere remains our intellectual property until full payment is received.

Once paid in full, you receive a non-exclusive, non-transferable license to use the deliverables for the agreed purpose (e.g., marketing, sales, internal promotion of the specified project or property).

You may not resell, distribute, or modify the visuals without written permission.

Arc & Sphere reserves the right to feature completed work in our portfolio, marketing, or social channels — unless otherwise agreed (e.g. via NDA or exclusivity clause).

For full or exclusive usage rights, a custom licensing agreement and additional fee may be required.

8. Privacy & Data

We care about your data. Please read our Privacy Policy for how we handle personal and project information.

9. Limitation of Liability

Arc & Sphere is not liable for:

Delays due to incomplete or delayed client communication
Business outcomes or marketing performance based on the visuals
Any indirect or consequential damages

Our maximum liability is limited to the total amount paid for the project in question.

10. Indemnity

You agree to indemnify and hold harmless Arc & Sphere from any claims or disputes resulting from misuse of our services, breach of these Terms, or violation of third-party rights.

11. Governing Law

These Terms are governed by the laws of Vietnam. Disputes shall be resolved in the courts of Hanoi, Vietnam.

12. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on our website, and your continued use of our services constitutes acceptance of the changes.
